These Terms of Service (“Terms”) govern your access to and use of the GradedTown website and services (the “Service”), operated by GradedTown Limited. By creating an account or using the Service, you agree to these Terms. Please read them alongside our Privacy Policy.
The Service is for individuals aged 18 or over who can form a legally binding contract. By using the Service, you confirm that you meet this requirement. We may suspend or close any account we reasonably believe belongs to a person under 18.
You are responsible for keeping your login details secure and for activity that happens under your account. Tell us promptly if you suspect unauthorised use. You agree to use the Service lawfully and fairly — in particular, not to manipulate prices or markets, interfere with how the Service works, use bots or scrapers, attempt to gain unauthorised access, or use the Service to break the law.
You can buy and sell graded cards at fixed prices and trade cards with other members. When you buy a card, ownership transfers to you once payment clears, and the card is held for you in the vault. Listings, prices, and availability can change at any time before you complete a purchase, and you are responsible for the accuracy of any listing you create.
Cards you buy or submit on GradedTown are held securely in an insured vault. Each tradeable card on the Service corresponds to a specific physical card held in the vault, and cards you own remain your property while we hold them for you.
You can submit your own graded cards to the vault by shipping them to us, at your cost, for authentication; we will tell you if a card cannot be accepted and arrange its return. You can redeem a card you own to have the physical card shipped to you. Redemption permanently removes that card from the tradeable vault and is subject to a shipping and handling fee shown before you confirm, identity verification, and the card not being part of an active listing or trade. Your GradedTown balance is held in New Zealand dollars. You can add funds by card through our payment provider, and money you make from sales is added to your balance. Where withdrawals are available, you can withdraw your balance to a bank account through our payment provider after completing the required payout setup. Reward points are a loyalty feature only — they have no cash value and cannot be withdrawn.
Any fees that apply to a transaction — such as marketplace fees or redemption shipping and handling — are shown before you confirm. All prices are in New Zealand dollars and include GST where it applies; GradedTown is GST-registered, and any GST on the fees we charge is already included in the price you pay.
Cards sold between members are supplied by the selling member, not by GradedTown, so you are responsible for any GST or other tax that applies to your own sales and gains. GradedTown does not provide tax advice.
The Service is aimed at users in New Zealand. You agree not to use it from anywhere its use would be unlawful, and we may limit or withdraw access where local law restricts collectibles or related services, or where required by sanctions or other legal obligations.
We provide the Service with reasonable care and skill, but except for guarantees that cannot be excluded by law, it is provided “as is” without other warranties. To the extent the law allows, GradedTown is not liable for indirect or consequential loss, and our total liability for any claim is limited to the amount you paid us for the transaction the claim relates to. Nothing in this clause limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
These Terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction. If something goes wrong, please contact us first — we will do our best to resolve it with you directly.
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, which cannot be contracted out of for consumers. Eligible consumer disputes may be taken to the Disputes Tribunal of New Zealand.
We may update these Terms from time to time. If we make a material change, we will give notice through the Service or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.
