Terms of Service | GradedTown

1. Acceptance of Terms

By accessing or using GradedTown ("the Platform"), operated at gradedtown.nz, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.

2. Eligibility

You must be at least 18 years old and a resident of New Zealand to use GradedTown. By creating an account, you represent that you meet these requirements.

3. Accounts

You are responsible for maintaining the security of your account and all activities under it. You must provide accurate information during registration. We reserve the right to suspend or terminate accounts that violate these terms.

4. Marketplace Rules

GradedTown is a marketplace for PSA graded Pokémon cards only. All listings must accurately describe the card, including the PSA certification number, grade, and condition. Counterfeit or misrepresented items are strictly prohibited.

5. Consignment & Seller Obligations

GradedTown operates on a consignment model. Sellers ship their PSA graded cards to GradedTown's Auckland facility (PO Box 300218, Albany, Auckland 0752) using tracked shipping. Upon receipt, GradedTown verifies authenticity against PSA's database, verifies each card, and creates the listing. Sellers must agree to the Consignment Terms before consigning. All consigned cards are insured while in GradedTown's custody.

6. Buyer Obligations

Buyers must provide a valid NZ shipping address and complete payment promptly. Purchased cards are held in the buyer's virtual vault. Buyers may request shipping at any time or continue collecting to combine shipments. Shipping is $10 NZD for 1–2 items, plus $5 per additional item. All shipments are tracked within New Zealand.

7. Fees & Payments

GradedTown charges a platform fee of 5% on completed sales, or $10 NZD minimum, whichever is greater. There are no buyer fees or listing fees. Storage-only consignment (no auction listing) costs $20 per card. All payments are processed securely via Stripe. Seller payouts are made via bank transfer and can be requested at any time.

8. Auctions

Auction bids are binding. By placing a bid, you commit to purchasing the item at your bid price if you are the winning bidder. Anti-snipe rules apply: bids placed in the final minutes may extend the auction duration. Listings cannot be modified or cancelled once live — please review all details carefully before listing.

9. Disputes & Refunds

Buyers may open a dispute if an item is not as described or not received. GradedTown will review disputes and make a determination. Refunds, when issued, are returned via the original payment method.

10. Prohibited Conduct

You may not: engage in fraud or deception; list counterfeit items; manipulate bids or reviews; harass other users; use the Platform for any illegal purpose; or attempt to circumvent our fees or payment system.

11. Limitation of Liability

GradedTown is a marketplace platform that facilitates transactions between buyers and sellers. We are not a party to the sale and are not responsible for the quality, safety, or legality of items listed. Our liability is limited to the fees collected on any given transaction.

12. Business Cessation

In the event that GradedTown ceases operations, all card owners will be notified via email and in-app notification. Sellers must arrange return shipping for their cards within 30 days of the notice at standard shipping rates. Cards not claimed within the initial 30 days will be moved to general holding, during which we will continue to make reasonable efforts to contact card owners. Any cards not claimed within 60 days of the original cessation notice will be considered abandoned. GradedTown may dispose of, donate, or sell abandoned cards at its discretion, with no obligation to the original owner. Sellers are responsible for keeping their contact details up to date.

13. Changes to Terms

We may update these terms from time to time. Continued use of the Platform after changes constitutes acceptance. We will notify users of material changes via email or platform notification.

14. Governing Law

These terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
